DEPUTY DIRECTOR: COMPLIANCE MONITORING AND ENFORCEMENT

Job Overview

The Pongola-Umzimkhulu Catchment Management Agency is hiring a Deputy Director: Compliance Monitoring and Enforcement based in Durban. Responsibilities include implementing and enforcing the National Water Act, conducting inspections and audits, managing non-compliance investigations, and coordinating with enforcement agencies. Candidates must hold a 4-year degree in Natural Science, Environmental Law, or Environmental Science, along with at least 8 years of relevant experience, including 5 years at middle management level. A valid driver's license and knowledge of water legislation are required.

Requirements & Qualifications

• A minimum of 4-year degree qualification in the field of Natural Science, Environmental Law, or Environmental Science or relevant NQF level 7 qualification.
• A minimum of eight (8) years’ experience in Compliance Monitoring and Enforcement.
• Five (5) years of experience should be at middle management level in Water Resource Management or related field.
• Knowledge of the National Water Act, 1998, the Water Services Act, 1997, related policies, strategies and guidelines and other relevant Acts.
• Technical knowledge and competence in project and programme management, policy and strategy development.
• Communication, interpersonal, presentation, negotiation, development skills, and general management.
• Willingness to work irregular hours.
• Knowledge of human resources policies and the Public Finance Management Act.
• A valid driver’s license.

Key Duties & Responsibilities

• Implement and enforce the National Water Act.
• Ensure implementation of compliance monitoring and enforcement policy, strategy, and standard operating procedures.
• Develop plans for inspections and audits.
• Ensure that compliance inspections and audits are conducted for various sector-related activities against legislation, policies, regulations and licenses.
• Analyse and verify inspection reports and provide advice on further actions needed.
• Provide information and support to the education and awareness component to promote compliance.
• Ensure that all dam safety inspections are conducted and compliance with national norms and standards is maintained.
• Facilitate and manage investigations of non-compliance with water use license conditions and other unlawful water uses and prepare reports.
• Implement enforcement action in the form of formal or informal warnings, administrative enforcement, statutory notices, directives, and criminal and court applications.
• Provide advice and input on criminal, administrative and civil litigation.
• Initiate prosecution against non-compliance through administrative enforcement.
• Prepare necessary information, reports and evidence for court applications.
• Assist in the development of policies and regulations.
• Ensure liaison, cooperation and coordination with other enforcement agencies and government institutions.
• Ensure management of assets and human resources.
